Terms and Conditions

IDENTIFICATION

1. Scope

1.1 These Terms and Conditions (“T&C”) govern every order placed on laforma.club (the “Website”) and form a legally binding contract between
(a) LA FORMA CLUB (“Seller”, “we”, “our”, “us”) and
(b) any natural person purchasing our products (“Customer”, “you”, “your”).
1.2 The Website sells LA FORMA I Bag Pillows—custom-made inserts that preserve the shape of luxury handbags. Products are offered exclusively for personal use. Resale or distribution is strictly prohibited without our prior written consent.
1.3 By ticking the “I agree” box at checkout, you confirm you have read, understood and unconditionally accept these T&C and the policies they reference (Privacy Policy, Returns Policy, Shipping Policy, etc.).

2. Ordering Process

2.1 Selection. Product pages show photos, dimensions and prices in euro (EUR). Minor colour differences may occur due to screen settings; photos are non-contractual.
2.2 Review. A summary page lets you verify the item(s), quantity and total price (including shipping and taxes) before payment.
2.3 Confirmation. After payment succeeds, you receive an order-confirmation e-mail. The contract is formed when we send this confirmation.
2.4 Cancellation. Orders cannot be changed once transferred to fulfilment. You may exercise your 14-day right of withdrawal after delivery (see § 7).
2.5 Account Accuracy. You must supply correct, complete data (name, address, phone, e-mail). We are not liable for delivery mistakes caused by inaccurate information; re-shipping costs will be charged to you.

3. Availability

3.1 All items are handmade; stock is limited. If a product becomes unavailable after you place an order, we will notify you by e-mail and refund the missing item(s) within 14 days.
3.2 We may update or discontinue products or prices at any time without notice.

4. Prices & Payment

4.1 Prices are shown in EUR, inclusive of Moldovan VAT where applicable.
4.2 Import Duties. If you order from outside Moldova, you are the importer of record. Local customs duties, taxes or handling fees are your responsibility.
4.3 Accepted methods: Visa, Visa Electron, Mastercard, Maestro, American Express, Apple Pay, Google Pay.
4.4 Payment provider. Card data are processed securely by our PCI-DSS-compliant payment gateway [Provider Name]; we never see or store your card number.
4.5 Full payment is captured at checkout. Ownership transfers only after we receive cleared funds; risk of loss transfers on delivery (§ 6.5).

5. Shipping

5.1 Shipping method. All parcels ship exclusively via EMS (Express Mail Service) through Poșta Moldovei and the Universal Postal Union network.
5.2 Dispatch time. Orders leave our warehouse within 72 business hours after payment confirmation (week-ends & Moldovan public holidays excluded).
5.3 Delivery times. Indicative EMS transit times by country are published on our Shipping Policy page; they exclude customs clearance delays.
5.4 Tracking. A tracking number is emailed once the package is scanned by EMS.
5.5 Unclaimed / returned parcels. If EMS returns a parcel to us (e.g., wrong address, unclaimed), we will refund the product price minus the original shipping cost. Re-shipping is possible upon payment of new postage.

6. Delivery & Inspection

6.1 Delivery is complete when EMS marks the parcel “delivered.”
6.2 Upon receipt, please inspect the contents before signing. If items are damaged or missing, note visible issues on the courier slip (where possible) and contact [email protected] within 48 hours with photos.
6.3 Failure to report transport damage promptly may limit our ability to claim against EMS and may void your right to replacement.

7. Returns, Exchanges & Refunds

7.1 Right of withdrawal. You may return eligible products within 14 calendar days of delivery without giving any reason.
7.2 Conditions: Items must be unused, in original packaging, with tags and invoice copy. Personalised or customised pillows are non-returnable.
7.3 Procedure:
a) E-mail [email protected] to obtain a Return Authorisation.
b) Ship the item(s) using a trackable service to: LA FORMA CLUB – Returns, 15/2 Mihail Sadoveanu Street, Apt. 71, Chișinău, Moldova.

7.4 Refunds. Once we verify the goods, we refund the product cost to the original payment method within 14 days. Original shipping fees are non-refundable unless the return is due to our error or a defective item.
7.5 Exchanges. If you request an exchange, outbound postage for the replacement is free. One exchange per order is permitted.

8. Legal Warranty

8.1 Our pillows are covered by the statutory conformity warranty under Moldovan consumer law (Law nr. 105/2003).
8.2 If a product is defective, notify us immediately; we will repair, replace or refund as required by law.
8.3 Normal wear, misuse, or unauthorised modifications are excluded.

9. Limitation of Liability

Except for wilful misconduct or gross negligence, our liability shall not exceed the purchase price of the item in question. We are not liable for indirect losses (loss of profit, data, goodwill, etc.).

10. Intellectual Property

LA FORMA I Bag Pillows and all related logos, product names, images and texts on the Website are our exclusive property or are used with permission. Any reproduction or commercial use without prior written consent is forbidden.

11. Personal Data & Cookies

Processing of personal data is governed by our Privacy Policy, compliant with Moldova’s Law nr. 133/2011 and (where applicable) the EU GDPR. The Website uses cookies to optimise navigation; you can disable cookies in your browser, but the site may not function properly.

12. Force Majeure

We are not responsible for failure or delay caused by events beyond our reasonable control (e.g., natural disasters, strikes, epidemic, customs delays, internet outages).

13. Governing Law & Jurisdiction

These T&C are governed by the laws of the Republic of Moldova. Any dispute shall be submitted to the competent courts of Chișinău, except where mandatory consumer-protection rules provide otherwise.
